BANGOR, Maine — A little over 30 minutes after voting to recommend taking possession of property owned by a couple seriously delinquent on their loans and property taxes, the City Council’s finance committee reversed itself.
After voting 3-2 to prepare a council order to take possession of the house and property at 110 Pearl St., the committee voted 3-2 against taking possession after a reconsideration motion was made by Charlie Longo and seconded by fellow Councilor Geoffrey Gratwick.
Monday afternoon’s committee meeting involved five agenda items, but the first one — an update and discussion on the workout agreement between the city and Peter and Jennifer Brown, who are five years behind on their property taxes — took up most of the 100-minute session.
City tax collector and deputy treasurer David Little updated the five-member committee on the agreement — approved in October 2010 — which initially was for 12 months and called for monthly payments of $800 with $200 applied to taxes and $600 going to mortgage loans and property insurance.
Due to what Little called “some payment issues,” the agreement later was extended until October 2012.
Since that extension, Little said, the Browns have made one payment and are now $4,150 in arrears. Because of the missed payments, there was not enough money in the escrow account to pay the annual property insurance bill.
The outstanding balance is $133,074 and the assessed value of the home and lot is $125,000.
The Browns, who filed an abatement application earlier Monday, attended the meeting. They said that Peter Brown suffered a severe concussion from a fall on his driveway and was unable to work for several months. Jennifer Brown has been working a part-time schedule with the Bangor school system but said she is only able to cover weekly bills and is unable to contribute to the payment schedule with the city.
Jennifer Brown said she received a $400 property tax refund over a month ago but had to use it to buy heating fuel after initially saying she just hadn’t had a chance to bring the money to the tax office.
Councilor Joe Baldacci proposed a compromise to accept a $400 Maine Property Tax Circuit Breaker refund the Browns received about a month ago and all of their anticipated $4,500 tax refund money and then reconvening in May to discuss the next step. The motion failed 3-2.
While stressing that they don’t like to have to be part of such discussions, Councilor Cary Weston and James Gallant voiced their concerns about the Browns’ ability to honor the agreement.
“This conversation is almost identical to ones we’ve had the past two years and I don’t see how circumstances will change,” Weston said. “While I sympathize with tough circumstances and tough times, as homeowners we make a commitment we have to honor.”
“I don’t want to continue to set a bad precedent giving people an idea that they don’t have to pay their taxes because they’ll be allowed to remain in their homes,” said Gallant.
The initial vote — taken after a long session involving committee chairman Nelson Durgin and fellow Councilors Weston, Baldacci, Gallant, Gratwick and Longo — was 3-2 with Durgin, Weston and Gallant voting in favor and Baldacci and Gratwick voting against. Neither Weston nor Longo are finance committee members. Weston was designated as a voting substitute for committee member Pat Blanchette, who was unable to attend. Longo was present as a nonvoting member.
Weston then left the meeting and Longo filled his spot.
After committee members attended to the other four agenda items, Longo asked if he could bring the Browns’ matter up for reconsideration.
City Solicitor Norm Heitmann said such a move was unusual, but so was a committee changing its membership over the course of a meeting, although he could recall times that had happened in the past. Heitmann said he could not recall a reconsideration motion made and voted on under such circumstances before in his tenure, but that it was allowed.
Gratwick seconded Longo’s motion, and Gallant objected, saying the move left a bad taste in his mouth. He also pointed out that the matter still would have to come to the City Council for a vote.
The revote came out 3-2 against taking possession of the house with Longo, Gratwick and Baldacci voting in the majority.
Baldacci then offered his earlier compromise motion again, Longo seconded, and this time it was approved 3-2 with Longo, Gratwick and Baldacci voting in the majority.
The matter will come before the full City Council for a vote on Monday, April 9.
When reached two hours after the meeting for reaction to the revote, Weston said, “no comment.”

What does a privately funded stadium have to do with this?
Oh yes every dollar will be privately funded. Even the cost of maintenance. if these people have so much money to fund why do they not do something productive about the dropout rate in high school Bangor has one of the highest in the state of Maine.
1. It’s cheaper to maintain a new, fake turf field than an old grass field. Your argument is a fallacy because the current upkeep on Cameron Stadium is a nonzero. There are costs to mow and plant grass, line the field, maintain the crumbling bleachers, etc. It is considerably cheaper to deal with turf because it doesn’t need to be mowed, the lines are all permanent (or longer lasting), the bleachers won’t be as old and hazardous or need as many repairs, etc.
Plus, teams like Bangor field hockey and maybe soccer and maybe a future lacrosse team will be able to play their games there. That means, the currently existing field hockey field won’t have to be kept in game shape, thus reducing maintenance costs there, too. Additionally, there is less concern about wear and tear on turf as compared to grass. BHS has to limit access to the field at Cameron so there is a playable surface for BHS football games. Without that worry, that field can be used for other events like John Bapst football (admittedly this already occurs) and field hockey games, plus community teams (say, Bangor Youth Soccer or Pop Warner football), and the city can charge those users rent. Look! A revenue stream!2. Bangor High is not even close to the highest dropout rate in the state. Perhaps there is a high RAW number of dropouts, but that is because BHS is a huge school compared to most statewide. The RATE, I would wager, is better than average.
I was going by percentages giving by the state of Maine website. Admittedly Know one know the drop out rate. Seems like it is a problem that is ignored. I was told it was 5% when I ask what percentages of kids will graduate. I did not ask the drop out rate. For all I care they could use broadway park to play football . When they have more serious problems in my opinion . Either they have know Idea what the drop out rate is or they flat out lie about it. Excellence in education for MOST not ALL.

What are referred to as mortgage payments are actually loan payments. The owner’s took a loan through the residential rehabilitation loan program and have not been keeping up on payments. I can’t give the answer about the insurance payments. I do know, however, that a couple of these loans do have some of the loan payment going to pay for insurance. I guess it covers the City’s investment should something happen to the building.
That would be good of the city to take over the home. Put another one in the homeless shelter. He comes somemore Shawn you will to hire another full time job to process if the city starts taking people out of there homes. Just because they can’t afford there taxes maybe bangor should lower there taxes mill to make it more affordable to live there. Maybe someone on the council has interest in the purchase of alot of the home in Bangor that have been forclose on.

The article makes it clear that this family has not made any of these payments in the last year, and possibly the last two. I can certainly sympathize with financial struggles, but at some point they need to be required to pay, if they get free housing, shouldn’t everyone?
if i did not pay my house payments i deserve to be evicted.no way any bank would give you over 2years to pay. as for the taxes this couple borrowed money from the city not to purchase the home but to upgrade it . it must be nice to only work part time when you are so far in debt.most people would find a new job or another part time one,why because only the city of bangor would put up with this, as long as these people have no fear they will not change. hope they are enjoying the free ride it will not last forever.

Really??? You want to put the blame on the city when the homeowner’s are the ones that are not meeting their end of this contract? It is called responsibility! More people should know how to accept some!
This couple sounds like they should be living in public housing. The reality is that not everyone can be a homeowner. I bet they would sleep a lot better at night.
These are hard times and maybe its time for some creative payment structure so that everyone can come out on top.Throw them out and you have possibly created a situation where the city would have to invest way more to house them compared to what they owe in back taxes.You can’t let them off the hook but there are ways to get the problem solved I’m sure.
I think the city has already tried the payment structure. I don’t know what more this couple expects the city to do, short of having the loans totally forgive. I understand that times are hard. However, these folks have a track record of not meeting their responsibilities. Look, I’m retired and living on a fixed income. My mortgage is $600 a month and it’s the FIRST thing that gets paid every month. I don’t have the sense that these people have made an honest effort to repay these loans.
This is simple. No Pay…No Stay!! The council is setting a precedent here. If you do it for one family, you better be prepared to do it for all the others!! No one can say that the Browns havent been given multiple chances…
Im more curious about the current council. One thing is clear, they dont like eachother and how does that translate into making intelligent decisions? Longo and Weston should consider putting on the ole boxing gloves…3 rounds…winner keeps their seat…loser goes away and keep their mouth shut! Where can I buy tickets for this event??
Very true I know Peter Brown and He is a Loser I had a son almost 22 years ago and never recieved a penny from peter hes never held a job that I know of So the chance of them getting there money is slim to none the only reason that peter has that house is his father passed and left it to him hes just a plain joke good luck getting anything from him

Based on the picture, they can afford to run an air conditioner. Perhaps a member of the family needs it for medical reasons.
There is sucha thing called a poverty abatement for those who can not contribute to the overall tax burden and everyone facing foreclosure should be given the ability to apply and be heard by the full council before any decisions are made. THE LAW SHOULD REQUIRE IT. In a multimillion dollar budget what is 3000 dollars.

Enough is Enough Councilors. This sob story is sad , yet time to cut your losses and move on. How many chances do they get? How many more of these sweet deals are the tax payers of Bangor subsidizing?

I had my heat set around 56-58 degrees all winter so I could pay other bills- including my mortgage and taxes.
I don’t understand why these people are continually given a free ride to live as they please. It isn’t fair to those of us who work hard to try to make ends meet and don’t get any sort of assistance at all.
Correction- they haven’t made a payment since 2007. They went to the council in 2010 to make an agreement that they could make some payments, and have yet to make any.
Send them on their way and help more deserving people who are actually trying to help themselves.
