Police and the county attorney in Lincoln, Nebraska, on Wednesday said there will be no charges in the report of a sexual assault at the residence of Nebraska quarterback Tommy Armstrong Jr., wide receiver Jordan Westerkamp and tight end Trey Foster.
No suspect has been publicly named in the case.
Lincoln Police Chief Jim Peschong said at a news conference Wednesday morning that the investigation is now complete. Police spoke with everyone who was at the home when the alleged assault took place, Peschong said.
Information on the investigation was forwarded to Lancaster County Attorney Joe Kelly. Filing charges would require proof beyond a reasonable doubt, Kelly said, and “that simply is not there.”
“I believe the victim,” Peschong said, but “we do not believe we have the elements of a crime.”
A 20-year-old woman told police on Nov. 15 that she was raped during a party at the home of the Nebraska players. The woman knew the alleged suspect, police said.
Armstrong leads the Big Ten in total offense and Westerkamp is among the leaders in the conference in receiving with 61 catches for 833 yards and seven touchdowns this season.
